The purchase of any product on the marinhoexpress.com online store implies the consumer's acceptance of all the terms and conditions of this Product Sales Agreement.
Considering that:

I - marinoexpress.com is a company whose main activity consists of the intermediation of products through the internet;
II - The user is a natural or legal person, duly registered with the COL, with a correctly completed registration, whose information has been validated by marinoexpress.com;
III - The user declares that they are acting in good faith and in full exercise of their civil capacity to enter into this Agreement, stating that they have understood, read, and agree with all the terms and conditions set forth herein.

OF THE PURCHASE AND SALE PROCEDURES  
Clause One: After making a purchase request for products in the online store, the user must wait for the receipt of a notification by email, informing them about the confirmation of the requested commercial transaction.

First paragraph: marinhoexpress.com reserves the right not to confirm the purchase and sale in the following cases:

I - User with incorrect or invalid registration information;  
II - Deliveries to locations outside the delivery areas available by marinhoexpress.com at the time of the purchase and sale;  
III - Fraud and bad faith, violation of any of the site’s terms and policies, abuse of rights, and/or any other situation that involves the violation of legal provisions or unlawful enrichment by the user, and in other cases provided for by applicable legislation.



Clause Two: The value of the purchase and sale will be provided in the confirmation email, and the user will be offered the payment methods available on the marinhoexpress.com website at the time of the purchase and sale.

First paragraph: Payment by credit card may not be approved in case of inconsistencies in the cardholder's information. The payment slip generated for the bank slip will be valid for 03 (three) business days and will be automatically canceled if payment is not made within that period.  
RIGHTS AND OBLIGATIONS


Return due to Change of Mind  
Clause Three: Product returns due to change of mind may be made up to 7 (seven) calendar days, counted AFTER RECEIVING THE PRODUCTS.

First paragraph: To exercise the right of change of mind, the user must contact marinhoexpress.com through the customer service email.

Second paragraph: After sending the change of mind email, the user must wait for contact from our team, who will inform them of the necessary procedures for the replacement of the item or the refund of the amounts paid.



Third paragraph: The return provided in this clause will only be approved by marinhoexpress.com after verifying the following:  
I - The effective return of the product to the supplier's distribution center;  
II - Confirmation by marinhoexpress.com that the product was returned unused, in its original packaging, accompanied by labels, manuals, and accessories;  
III - Approval of the exchange or return by marinhoexpress.com’s quality control, which will be carried out after an analysis within a period of up to 10 business days;

Fourth paragraph: If the user exercises the right of change of mind in disagreement with this clause or the agreement and/or if any discrepancy or violation of the returned product is identified, the return will not be accepted, and the product will be returned to the user without prior notice.



EXCHANGE DUE TO DEFECT OR PRODUCT FAILURE

Clause Four: The exchange of products with defects or manufacturing faults may be made as long as the request is made within the legal warranty period, after receiving the products, as established in Article 26 of the Consumer Protection Code.

First paragraph: To request an exchange, the user must contact marinhoexpress.com through the customer service email.

Second paragraph: The exchange provided in this clause will only be approved by marinhoexpress.com after verifying the following:

I - The effective return of the product to the supplier's distribution center;  
II - Confirmation by facilitaja.net.br that the product was returned along with manuals and accessories;  
III - Approval of the exchange or return by marinhoexpress.com’s quality control, which will be carried out after an analysis within a period of up to 10 business days;

Third paragraph: If the user exchanges the product in disagreement with this clause and/or if any discrepancy or violation of the product is identified, the return will not be accepted, and the product will be returned to the user without prior notice.

REFUND PERIOD

Cláusula Quinta: En el caso de que el pago se haya realizado mediante tarjeta de crédito, el reembolso se realizará en la misma tarjeta de crédito, y será visible para el usuario en hasta 2 (dos) facturas después de la conclusión de la restitución, pudiendo variar de acuerdo con la fecha de vencimiento de la tarjeta. En el caso de pagos de productos realizados mediante boleto bancario, el usuario será reembolsado en su propia cuenta con el intermediario financiero.



DELIVERY TIME AND CONDITIONS

Clause Six: Products are delivered from Monday to Friday, between 08:00 and 21:00, and the estimated delivery time will begin only after payment confirmation and logistical processing.

First paragraph: The product delivery service is carried out exclusively by Royal Mail©, who is responsible for meeting delivery deadlines and stages for the user.

Second paragraph: Delivery may be made directly to third parties, such as doormen or family members.

Third paragraph: Delivery may not be completed within the stipulated time due to:

I - The user’s absence at the provided address;  
II - Incorrect registration information;  
III - Rejection of the product by the user or a third party;  
IV - Change of the user’s address;  
V - The occurrence of an event of force majeure, such as floods, natural disasters, large-scale accidents, or other situations that prevent the delivery from being made;  
VI - Strike or suspension of activities by Royal Mail©;  
VII - Significant increase in demand by Royal Mail©;  
VIII - Due to holiday periods, such as Christmas and New Year.

Fourth paragraph: The delivery period for products is between 5 to 15 business days after shipment, according to Royal Mail©'s rules. The period may extend up to 90 business days due to the reasons stated in the Third Paragraph of this clause.

Clause Seven: This contract aims to ensure consumer service in accordance with Article 4, item IV, of Decree No. 7.962/13.

Clause Eight: marinhoexpress.com reserves the right to cancel the commercial transaction if any situation is identified that constitutes fraud, bad faith, non-compliance with any of the site’s conditions and policies, abuse of rights, and/or any other situation involving the violation of legal provisions or illicit enrichment.

Clause Nine: The relationship between marinhoexpress.com and the user is exclusively regulated by the terms established in this contract.

JURISDICTION

Clause Ten: The jurisdiction for resolving any matters related to this contract will be that of the consumer's place of residence.
